Hi All,

I would like to know if i can file multiple 485s being primary on both ?

Here is my current status ...

1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)

So my question is can i have two 485s filed ?

First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.

I am confused, what to do now.

Any advice is appreciated.

Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?

I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!

Prohibiting employees from paying the H1B application fees is not a new policy. It has always been there.

However there is a new policy prohibiting employees from paying Labor related expenses in GC process.

Hi All,

I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.

I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

I changed jobs twice after I-140 approval/180 - days of filing 485. I am in the 6th year of my H-1B. Both the times I transfered my H-1B and got validity for 3 years based on AC-21.

Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.

My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?

hi everyone

I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.

Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)

2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )

Any comments or suggestions will be appreciated.

No, you do not need to file I485 for child, who is a us citizen. No medicals exam required, since they get everything here after birth.
But you have to mention child details on your I485.
I recently filed mine.

U.S. Department of Labor has implemented a new integrated online system � known as the iCert Portal � through which employers can submit applications for permanent labor certification, labor condition applications (LCAs) and other applications for immigration-related DOL programs. In addition, the agency will introduce new editions of Form ETA-9089, the PERM labor certification application, and have already introduced Form ETA-9035, the labor condition application. iCert has already replaced the method of LCA filing for H-1B. The new iCert system begins to accept LCAs as of July 1, 2009. Employer and attorneys as the case may be, can still use the old LCA account but cannot submit new LCA. New LCA has to be filed from iCert.

Following are the new changes which has taken place:
- The new LCA requires writing the SOC (ONET/OES) code and the occupation title for the job.
- The new LCA has a section for basis for the visa classification supported by the application. There are the following categories:
a. New employment;
b. Continuation of previously approved employment without change with the same employer;
c. Change in previously approved employment;
d. New concurrent employment;
e. Change of employer;
f. Amended petition.
- One has to indicate the total number of H-1B/H-1B1 (http://www.h1b.biz/lawyer-attorney-1137085.html) non-immigrant workers.
- The new LCA also requires, in the employer information section, to indicate the Trade name/doing business as (DBA), if applicable, the old LCA does not have this requirement.
- In the new LCA, one is required to write NAICS code.
- There is a new section in the new LCA - Employer point of contact information, which requires to indicate the following: full contact�s name; contact�s job; contact�s address; contact�s telephone number; contact�s e-mail address.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Guys i have few questions and would really apprecite if you could help me the best of your knowledge.

1. I saw my 3 years extension of h1b has been approved. I am now thinking of going for stamping. Earlier i had been to canada for stamping as at that time getting appointment at indian consualte was difficult. How soon can i get at chennai consualte?? I heard for NRI's they give diferent priority ..is it true..???
Whats the website to schedule the appointment at indian consulate..???Is it dizyy to get stamping in chenna..???I have a US MS degree in CS.

2. My online status says H1B is approved and aproval notice sent. I shoudl also get an new I94 right..???there were few conserns for my attorney when we filed application..so want to make sure everything is proper before i start thinking of next step..(stamping and all).

I would really apprecite if you get share your views on my concern.

You are okay, when you leave current employer, make sure there is not an overlap in dates when you get paycheck from there and get paycheck from new employer. couple of days won't matter but if there happens to be gap of more than 2 weeks you will probably need to explain that later at the time of 485 approval
