Hi Everyone,
I've got couple of questions.
1. I'm on F1 and got pregnant. Can i take a break for sometime and get back to studies?
2. My husband is a GC holder..well we got married after he got GC ( i know what you guys must be thinking :-))...now can he apply for a family based GC for me, i kind of know that it takes atleast 4 yrs for me to get GC...but just wanted to make sure that he can apply while i'm on F1...pls share your views...

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
Not necessary. It is enough that you file your H1-B renewal before expiration date. i.e. your H-1B renewal receipt date should be before your expiration date.
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
No, you cannot travel if your H-1B renewal is pending. You can only travel after you are approved. So, if you plan to travel and come back before your present H-1B expiry, you should not apply for renewal until you come back.
Any suggestions are most welcome. Thanks in advance.

Also here is my next question. When my H1B extension is pending, can I change my employer? Should the new employer wait for my H1B that will be renewed or does the new employer apply for a fresh H1B renewal? I guess he cannot do this because I will out of status for 7 months and this might turn out to be illegal. Someone plsssssssss answer my questions!

Yes. You will get all the tax rebates. I remember getting the rebate check after 2001.

I am unable to determine if the 180 day timeline is calculated from RD or ND? There are different opinions here in this forum and no clear answer. Is there a law text that defines this clearly...does anybody know?

I am on H1-B, and about to apply for I140.
My wife has recently got a F1 visa (and her H4 visa has been left valid).
I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

Your wife's H4 is no longer valid since she switched to F1. You cannot hold non-immigrant status in two different classification at the same time. However, I think it is okay and even expedient that you mention her in your I-140.

I had a similar issue during my first H1B visa stamping. My H1B was approved from company ABC and after approval name of the company was changed to XYZ. So, my employer gave me copy of a letter issued by State of Maine (Company ABC was registered in Maine). This letter stated that company XYZ is same as ABC. My passport was stamped with company ABC's name. My employer also gave me a letter stating that XYZ is same as ABC.
Not sure how this name change will affect your I-140 or I-485.

I applied for H1b visa transferred in Nov 08 inspite of not having recent pay stubs. After applying transfer, I started working for new employer.
Last week I got query from USCIS asking my latest pay stubs (Oct 08) and yesterday I got Laid off from my new job after working for 4 months (till Feb 09).
My husband is on L1B visa.
In my case
1. Shall I consider transferring to L2? for this do I need to go to my home country (India) for L2 stamp?
2. If COS to L2 is approved, Can I work on my old H1B again if I find an employer who is ready for transfer?
3. If I travel to my home country(India), will my H1B visa be cancelled? as currently i don't have any H1B approval.
4. Whether the Request For Evidence(REF) on my H1B transfer will have any implication on L2 stamping?
Please help ..
