Hi,
I am really confused about my current status.
I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.
I got my petition approved, but my change of status was denied.
The reason was stated as :
The status previously accorded the worker had expired before this petition was filed. Therefore, the worker si not eligible for change of status.
Now, I am still in US. Is my status illegal?

To the best of my knowledge, e-filed applications for EAD and AP renewals usually trigger biometrics appointments. If applications for EAD and AP renewals are filed the old-fashioned way, biometric appointments will probably not be required.
With respect to your second question, you must be physically present in the US to file tha application for Advance Parole.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.

I like both, initially perhaps the color version a bit more. If you can touch up the slight red-eye problem. The faded border works better with the b&w though, so all in all I'd finally go with the b&w. Cute girls!

Hi,
Company B has applied for I-140 and 485 because you will work with them for a min of 6 to 12 months after getting GC.
So its not required for you to join them if they have already submitted I-140 and 485. You can say that you will join them after getting GC.
And if the 485 takes more than 180 days for the approval from the receipt date you can apply the AC21 portability rule and submit a new employment offer from anycompany and you can join that company.(Provided I-140 is approved and if I-140 is pending for more than 180 days then you can port the I-140 priority date by restarting the whole GC process)
Above is the knowledge I got from IV and google.
So u dont need to worry and join the company B, but keep them happy since they have to respond to all RFE till I-140 is approved.

Here is a clear example of business leaders moving ahead of the politics of this issue. It will have an impact on any sensible person.
It should get onto as many news wires as possible. Which sensible person can say that those 1000 high paying jobs going to Vancouver/Canada is in the interest of Seattle/USA. Imagine to spin off losses of this, to housing, to retail, to all sorts of areas of the economy where many Americans make their livelihoods.
This is what people don't understand, push them too far and capitalists will weaken the US economy.

An A# is allotted whenever you file for AOS (either employment or relationship based or any other category eligible) and the USCIS accepts your I-485. This will be your A# for the rest of your life and will be on any subsequent filings (irrespective of the category .. immigrant or non-immigrant) with the USCIS.
I am not really sure about the A# allotted when you file for F1/OPT (I never had an F1). Please check with a qualified legal specialist.

I don't think it is necessary to renew his passport in India. I heard though they suggest having 6 month of passport validity, POE will let you in even if the passport is going to expire the next day. At the time of entry the passport they are carrying should be valid.
I read this in a blog but use it at your own discretion.
BTW is your son is on H4? How could he be able to come to US on 1st Sep 2009 when the H1B expired on 14th Jan 2009? (or is it a typo and should be read as 14th Jan 2010)

and have a following question:
Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".
Here is my situation:

Does 1 require a UK Visa if they are travelling on British Airways? As i have my parents travelling from India to USA on British Airways(they have Multiple B1/B2 US Visa)..
Spoke to BA &they advised me to speak to UK Consulate.:(

1. Should H1 B Job and GC Job be related? I am going for an H1 B extension based on approved I 140.
2. Can we consider Software Quality engineer on H1B and Software engineer on GC related?
The NAICS occupational codes for
Software Quality Engineer is 541511
Software Engnieer is 541710
Can we consider them related for AC 21 purpose. I so not have the approved labor or I 140.
3. Currently am on H1 which is going to expire next month with my current employer and had my GC filed as a software engineer. I am planning to move over to the client where right now am working as a contractor. I am being offered a position as Software Quality engineer.
Now, do I use the H1 extension and go on to the client or use EAD? If I go onto the client on H1 extension, what happens to the GC process and my EAD?
When I leave the company and if the current employer withdraws the I 140, am I ok?

The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

If you don't intend to change your employer, you can travel on AP, comeback and continue working on H1B.
