Dyekek12 - my friend....We all are here only wishing the best for each other.! There has to be a reason why majority of folks who responded to to ur post in fact agree with what i had to say...This country is full of opportunity - no doubt about that.! But boy - one has to heavy, heavy price for that.!! A price that a lot of folks on this forum have to come to see - one that is not worth it.!. Yes - i am talking about the GC. Something that promises you all the freedom, flexibility, mobility that each one of is entiltled too.! But the road to get the GC is a road better not taken.! The only reason most of the folks here think alike - because we're already on this extremely bumpy road...invested time, $$, energy into all this.! And we all have been bought to a stage where we are standing outside the temple but are not allowed inside to seek blessings.! We don't know when we will be allowed inside..?? This is the anxiety that ends up eating u inside.!! Extremely uncomfortable, uneasy and anxiety filled scenario.!!

I will be using AP first time. What documentation do we need to enter (other than passport and un-expired AP)? I will be visiting India for about 1 month? Is there any limitation as to for how long you can leave the country? I got 2 copies of AP. We just need "one" right?
Also while leaving which I-94 should we surrender? The one which I got when I entered last time - a couple of years ago, or the one which I received with last H1b renewal documentation. Right now I am not using H1b. I am "on" EAD.
Please share your experiences.

Hello All,
The lawyer did send separate checks and the applications were sent in a single package. As stated earlier I got my receipts. But my wife's check is not cashed yet. But today's (Aug 17th, 2007) receipting update from USCIS http://www.uscis.gov/files/pressrelease/ReceiptingTimes081707.pdf states that they have completed for July 2nd filers. Mine was submitted on July 2nd 2007. What are my options now?
1. What could be done if my wife's application was lost by USCIS?
2. What are the chances that I can re-file my wife's application again?
Please answer.

It is response like these that give us some hope to this never ending quest.
It is good to know that you can file a New PERM and a second I-140.
But do you know whether we can file a New I-140 on the basis of the original labor instead of filing a New Perm? I ask this bcoz in cases like mine where i have already exhausted 6yrs, would be difficult to file a PERM now.
I see in some other thread, they did file a new I-140 and they were requested to first withdraw the Appeal, but in that case, do we know whether the new I-140 was approved first before we withdraw?

This slumdog needs a solid, old fashioned butt whipping: open to public, health-care-debate-like telecast, take his pants off, bend him over, highest priority to curry with Z-E-R-O U.S. education.
Who exactly is Ron Hira? What is his motive? why is he doing all this? And why is he so influential?
I am under the impression that he is influentiaal because he does what the antis like.
On a broader note - we all would be happy to see a system which is not so complex and there is a well defined process which Ron Hira also says he wants to see, but his bashing of foreign nationals and employers says he is basically of the kinds "shut the door behind me" attitude.
But I know the end.

I have a question on changing jobs. I am on my second H1b and my h1 expires in a little over a year. I have a possible offer for a job and would like to change. My question is if i DO change jobs right now, can i still apply for my PERM and will i be eligible for further h1b extentions?
A friend mentioned to me that your labour needs to be applied for atleast one whole year (even if it has been approved in PERM), to be able to apply for any kind of H1 extentions.
Can someone on here please tell me what the law is on H1B extentions and how it works exactly in a case like mine.

If ur current employer did not apply for a labor, it doesnot matter anyway, as u r in the same position.
Ur friend is right. However if ur I-140 is also approved, u will continue to get H1-B extensions beyond 6 years.

This is really now a high time we need to do something, Green card is delayed, we have been patiently waiting, now EAD renewal is also delayed, I applied for AP renewal it is more than 2 and half month and it is delayed.
Why are legal and regular tax payer like us troubled so much ? , they want money take it, but provide efficient service ?
I am really surprised that there is nothing we can do ?

I filed I 140 and I485 and 180 days completed. I got an RFE on I 140 for Ability to Pay.
I have another I140 already approved with earlier PD.
Can I interfile when there is an RFE on I 140?

You will find very few insurnce companies willing to provide coverage for a pregnant lady and even if they cover it they won't cover much. You will still end up paying most of it.
Your best bet is to convince your employer to add your spouse to your insurance and pay him the insurance amount. Most employer sponsored health plans allow dependents. Talk with your HR or call the insurance company directly and ask them if you can add dependents to your insurance. Don't mention that your wife is pregnant.
If you are able to add your wife to your insurance then they can't deny benifits for pregnancy as pre-existing. Pregnancy is not a pre-existing condition. They will have to cover it. So the best and cheapest for you is to somehow get her added to your empler sponsored insurance.

My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

How's Asking for temperory Lifting Country Cap or Exemption of Long pending case from Country limits going against her own bills ? Nothing 'Immigration' is flying right now, we already saw the fate of those bills...I have heard this several times from various lawmakers offices they don't want to lift the country caps... Recapture is a good option if you want to do it right. Otherwise all ROW will oppose you. How are you different than the guys who open threads against Telgus or EB3 vs EB2 or against Muslims.
What you are doing is only dividng the community. My collegues who are also IV members are mad reading that someone in IV is pursuing a one point agenda against ROW. We need to stop such threads. A lot of ROW are quiet members on IV forum and they will be upset.
Country caps can only be supported if there is recapture or increase in visa numbers.
